Penal Code, 1860–Sec. 304-A–Change for the offence of medical negligence–Condition of lady was deteriorated after giving birth to child–She was referred to Govt. Hospital Udaipur–Distance could have been covered in 1-1/2 hour, however, she was admitted after seven hours–It cannot be held that the petitioners delayed her reference to higher hospital–Death was caused due to vaginal injuries and haemorrhagic shock which can occur during the normal delivery–No case of medical negligence–Trial Court committed error in ordering to read out the accusation u/s. 304-A.
