Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Application for restraining the defendants from operating the petrol pump on the land in question–Rejection of –Instant appeal–Observation of the Trial Court that there is a good prima facie case in favour of plaintiff which has not been challenged by the defendants–However, the petrol pump has already been established and has come into operation over the land on the basis of LOI issued by the Company in favour of defendant-respondent no. 1–If the plaintiff succeeds in the suit, he can be compensated by handing over the land in question, but if the operation of the petrol pump is stayed at this stage and after substantial time, it would not be possible to compensate the defendants–Defendants would be facing comparatively more hardship and irreparable loss–Interference declined.
