that he acted negligently or omitted the prescribed conditions in exercise of the statutory powers–It is also not a case of unbecoming of the govt. servant–Land was in name of U.I.T. and not in name of State Govt.–Only allegation of having exercised the jurisdiction not vested–Held, proceedings are liable to be quashed and set aside.
