Code of Civil Procedure, 1908–Order 6, Rule 17–Defendant Company was merged with other Company and its name was changed to JSW Steel Ltd.–After accepting the application under Order 6, Rule 17, no fresh notice was issued to the defendant–Effect–Defendant itself filed the application under Order 9, Rule 7 in the instant suit–Once the Company had the notice of pending suits, merely based on the averments made in the applications, seeking change in the name of the defendant, cannot entitle it to get a fresh notice–Further, it was the application under Order 6, Rule 17 and not under Order 1 Rule 10–Plea of appellant has no substance.
