Code of Civil Procedure, 1908–Order 41, Rule 19–Dismissal of restoration application with the observation that it was filed after the delay of seven years–As a matter of fact, restoration application was filed on 23.02.1992 i.e. within one month from the date of dismissal of the writ petition–This fact is admitted by the respondent-State in the counter affidavit–Appellant still claims to be in the possession of the land under acquisition–Impugned order passed by the High Court set aside and matter remitted back to restore the writ petition.
