Motor Vehicles Act, 1988–Sec. 163-A–Legal aspects of Section–In a claim u/s. 163-A, no pleading or proof on part of claimants showing absence of wrongful act being neglect or default is required but the claim can be defeated by the owner or Insurance Company by pleading and proving wrongful act, neglect, or default on part of claimant/deceased.
