Negotiable Instruments Act, 1881–Secs. 138 & 143–Provisions of the summary trial would be applied in the offence of dishonour of cheque–However, if the nature of case requires passing the sentence of imprisonment exceeding one year, the Magistrate after hearing the parties, record an order to that effect and thereafter recall any witness and proceed to rehear the case in the manner provided as Cr.P.C.
