Negotiable Instruments Act, 1881–Sec. 138–Code of Criminal Procedure, 1973–Sec. 263–Summary trial–Offence u/s. 138 is an offence based on documents hence, in summary trial, the plea of accused is to be recorded u/s. 263(g) and his examination, if any, can be done by the Magistrate and a finding can be given u/s. 263(h) after summoning him.
