Penal Code, 1860–Sec. 458–Establishment of offence–Prosecution must prove that-
(i) the accused committed lurking house-trespass by night or housebreaking by night,
(ii) he did as above after having made preparation for causing hurt, or for assaulting, or for wrongfully restraining some person, or for putting someone in fear of hurt, assault or wrongful restraint.
