Code of Criminal Procedure, 1973–Sec. 457–Essential Commodities Act, 1955–Secs. 6-E & 3/7–Denial from the release of vehicle in light of the provisions of Sec. 6-E of the Act–Merely because the vehicle is subject to confiscation, right of the owner to use the vehicle during the pendency of the case should not be taken away–if the vehicle is kept seized, it would be nobody’s interest–It would be appropriate to direct the petitioner to furnish the bank guarantee equivalent to the value of the seized vehicle–Directed accordingly.
