Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Order of status quo was modified by appellate Court upto permitting the respondent to raise the construction on the land covered by his patta–Final rights of rival parties in relation to the land having width of 4.5 inches shall be decided on adjudication of the suit and counter claim–Defendant cannot be deprived of his right to enjoy his rightfull possession and ownership over the undisputed part of land–Held, no interference is required in the impugned order.
