Rajasthan Minerals (Prevention of Illegal Mining, Transportation & Storage) Rules, 2007–Validity of Rules–Under challenge–Ground of the petitioner that the Act of 1957 does not give the jurisdiction to State Govt. for the specified minerals/major minerals–Sec. 23 of the Act deals with the power of State Govt. to make rules for the prevention of illegal mining, transportation and storage irrespective of the category of minerals and without drawing any distinction and by using the generic term ‘Mineral’; such power would be exercisable to frame rules for both minor and major minerals–Rules cannot be termed to be ultra vires.
