Wild Life (Protection) Act, 1972–Secs. 2(16), 9 & 11(2)–Act of hunting–Purview of–For an act to qualify as hunting, there must be a preparation, intent and an effort to trace and kill the animal–The conduct of villagers, driven by an immediate and overwhelming apprehension of danger rather than any premeditated intention to capture or kill the animal, does not fall within the ambit of the prohibited activities u/s. 9–It was a case wherein the villagers were attacked by a wild panther and they were passing a continued threat–The situation demanded immediate action to protect a follow villager from further attack–Provisions of Sec. 81, IPC apply in the instant case–FIR is liable to be quashed.
