Code of Criminal Procedure, 1973–Sec. 438–Penal Code, 1860–Secs. 420, 467, 468 & 471–Anticipatory bail–Allegation that the petitioner is co-accused for getting a lease fraudulently–Lease deed was executed in the year 2005 and a civil suit is pending in regard to the aforesaid lease deed–No interim order has been passed by the Civil Court against the petitioner–Complaint was lodged in the year 2005 and 19 police officers were deputed for investigation–Petitioner is not connected with the allegation of induction and removal of directors–Petitioner is depositing the rent as per lease deed in the Court–When the lease was executed in his favour, he was aged 19 years and was engaged in his studies–Investigation is going on for last 19 years–He has been interrogated by the Investigation Officer and has submitted the relevant documents–It will not be justified to allow the Investigation Agency to arrest the petitioner–Bail deserves to be granted.
