the offence–Sustainability–Allegation of mentioning the wrong fact in nomination paper–Remedy available to the complainant was to challenge the election of the petitioner before the appropriate forum–Disqualification pertaining to the third child cannot be considered so as to constitute the offence of cheating–Even if the offence of furnishing of false information is made out u/s. 171, same can be pursued by the concerned public officer–FIR is liable to be quashed.
