Code of Civil Procedure, 1908–Order 1, Rule 10 & Order 6, Rule 17–Specific Relief Act, 1963–Sec. 12–During the pendency of suit for specific performance of sale agreement, paternal uncle of respondents executed the gift deed in favour of P–Petitioner filed the applicaton to implead them as the respondent parties as also sought the amendment in plaint as regard to cancellation of gift deed–Rejection of both applications–Justification–If the aforesaid persons are not allowed to be impleaded as defendant, it would definitely create multiplicity of the proceedings between the interested parties–Both the applications are liable to be allowed.
