Code of Criminal Procedure, 1973–Sec. 254 [Corresponding Sec. 277 of BNSS, 2023]–The accused has a right to apply for the issuing process for compelling the attendance of any witness by filing the application u/s. 254(2) which can be rejected by the Court concerned only when it finds that the same has been filed either with an intention of causing delay in the trial or the witness sought to be summoned, is not required–In the instant case, petitioner-accused had taken a defence that he had handed over the blank cheques to witness O and these have been misused by the complainant–Application deserves to be allowed.
