Evidence Act, 1872–Sec. 65–Application for producing the secondary evidence–Allowed–Secondary evidence can be permitted to be produced when the original has been destroyed, or lost or when the party offering evidence of its contents cannot for any other reason, not arising from his own default or neglect, produce it in a reasonable time–In the instant case labour Court was asked to produce a report with regard to a search warrant–Reply of Labour Court that despite of search same could not be discovered–Held, carbon copies produced by P.P. were rightly allowed to be taken on record.
