Evidence available on record revealing that the complainant received the cheque of due amount of loan as also as he got executed the document of sale of house in his favour–He also admitted this fact that he made an attempt for taking the possession of house–Contradiction in the facts as regard to making payment and period thereof–Legal due is not established–Held, petitioner is entitled to be acquitted.
