Code of Criminal Procedure, 1973–Secs. 319 & 300–A person who has already been discharged–Whether can be summoned u/s. 319 ?–Held, yes, however, only after an inquiry as contemplated by Secs. 300(5) & 398–If during or after such inquiry there appears to be evidence against such person, power u/s. 319 can be exercised.
