Code of Criminal Procedure, 1973–Sec. 391–Whether a statement made by a witness and evidence coming into existence subsequent to the judgment of the trial Court can be permitted to be produced as additional evidence u/s. 391 ?–Held, no–A witness can be cross-examined/confronted/contradicted only on the basis of his previous statement–A statement of the witness coming into existence after recording of his statements during trial cannot be used for the aforesaid purpose–There is no provision which allows the use of such evidence–As a witness can not be cross-examined/confronted/ contradicted only on the basis of his previous statements in such situation.
