Code of Civil Procedure, 1908–Order 21 & Sec. 47–Limitation Act, 1963–Arts. 135 & 136–Execution third application–Maintainability–Issue of limitation–Decree was for only mandatory injunction and not for permanent injunction in future–Execution application could have been filed with in the period of three years after two months of disposal of appeal i.e. till 04.05.2008–Further, the earlier applications were disposed with the observation that the compliance has been completed–Possession cannot be removed on the basis of subsequent construction after the earlier mandatory injunction order–Instant proceedings are barred by limitation–Application u/ss. 47/151 C.P.C. deserves to be allowed.
