Stamp Act, 1899–Sec. 35–Registration Act, 1908–Sec. 49–In the suit for permanent injunction, Trial Court was of the view that the question of the document being required to be registered and to be stamped shall be decided at the time of final decision–Justification–It was obligatory upon the Court below to firstly decide the admissibility of such document which is contended to be unregistered and unstamped before the same being taken in evidence–Impugned order quashed and set aside and matter remanded back for deciding afresh.
