Code of Criminal Procedure, 1973–Sec. 475–Penal Code, 1860–Sec. 307, 365, 459, 460, 353, 332 & 333–Committal of the case u/s. 209 Cr.P.C.–No application u/s. 475 or under the Rules of 1978 was filed by the defence–Magistrate was constrained to commit the case to Sessions Court–It appears that the application was preferred before Sessions Court–Magistrate did not commit any error in committing the case–Impugned order passed by the Revisional Court is liable to be set aside.
