Penal Code, 1860–Sec. 304-B–Evidence Act, 1872–Sec. 113-B–Expression “shall be deemed” used in Sec. 304-B & expression “Court shall presume” used in Sec. 113-B–Prosecution is first to show all the ingredients of the offence so as to shift the burden of proof–Once all the ingredients are present, the presumption of innocence fades away.
