Registration Act, 1908–Sec. 17(2)(vi)–Compulsory registration of a decree–Requirement of–In the decree of the earlier suit, only the suit property was made part of decree–Pre-existing right of plaintiffs was admitted by the defendants and the decree was passed accordingly–It was expressly covered by the expression “any decree or order of a Court”–Applicability of Sec. 17(1)(b) cannot be imported in Sec. 17(2)(vi) by any indirect method–Held, the conclusion of first appellate Court and High Court that the decree dated 19.1.1995 was null and void due to non-registration is erroneous–Judgment and decree passed by trial Court deserve to be restored.
