Code of Criminal Procedure, 1973–Sec. 293 & 391/311–Prayer for granting the permission for examination of Asstt. Director of FSL who submitted the exhibit–Refused–Justifi-cation–Sec. 293(2) empowers the Court to summon and examine any such expert as to the subject of his report–It does not speak that the right of the accused of fair trial and of fairly contesting the trial is taken away by the said provision to disable the accused to cross-examine the expert who had submitted the report–Trial Court committed error in dismissing the application.
