Rajasthan Municipalities Act, 1959–Sec. 271–Dismissal of suit for declaration and permanent injunction on the ground that appellant had not served the notice u/s. 271 before filing the suit–Suit was for declaration and injunction both and not simplicitor for injunction–Further, the objection was not waived by defendant as he took specific stand in written statement in regard to this issue–Held, Court below rightly hold that the suit was not maintainable.
