Negotiable Instruments Act, 1881–Sec. 138–Whether once the settlement has been entered into, the complainant can be allowed to pursue the original complaint ?–Held, no–The settlement agreement subsumes the original complaint–Non-compliance of the terms of the settlement agreement or dishonour of cheques issued subsequent to it, would give rise to a fresh cause of action attracting liability u/s. 138 of the Act and other remedies under civil law and criminal law.
