Code of Civil Procedure, 1908–Order 37, Rule 3 & Sec.151–Delay of 20 days in appearing before the Court–Order 37, Rule 3 clearly provides for the defendant to make his appearance before the Court within a period of ten days after the service of summons–Speedy disposal is desirable under the provision so as to prevent any monetary loss to the concerned party–Held, application u/s. 151 for condonation of delay was rightly rejected.
