Transfer of Property Act, 1882–Secs. 53A & 54–Agreement of sale–Though it is not the document of title yet the entire sale amount of sale consideration was paid and the plaintiff-respondent was put in possession of the suit property in accordance with law–Therefore, he was having the defacto possessory rights over the property–Entry of defendant over the part of the property was simply as a licencee and he does not continue to occupy it in the capacity of the owner–After the termination of licence, he has no right to remain in possession–Held, decree of eviction with mesne profit in favour of plaintiff was justified.
