Evidence Act, 1872–Sec. 65–Rajasthan Stamp Act, 1998–Sec. 33–Registration Act, 1908–Sec. 49–Secondary evidence of the document was allowed to be produced in evidence–Document in question is not the rent note, and it is the lease deed–Same was not required compulsory registration, however, payment of proper stamp duty was required to be paid for taking it in evidence of collateral purpose–Non-payment of stamp duty was not considered by the Court below–Impugned order set aside and matter remanded back for passing the order in accordance with the law.
