Penal Code, 1860–Sec. 302–Conviction–Sustainability of–No step was taken to recover the alleged weapons used in the incident–Blood stained earth was claimed to have been seized from the place of occurrence but it was not sent for chemical examination–Different versions of eyewitnesses in regard to place of the incident–Enmity between both the parties–Witnesses were found inimical–They denied from the fact of injuries sustained by the accused, whereas the injuries were found on the person of accused–Held, conviction cannot be sustained.
