Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Tenancy Act, 1955–Sec. 207–Rejection of counter-claim was sought by the plaintiffs with the contention that the defendant sought the possession of the agricultural land–Rejection of the application–Justification–Suit filed by the plaintiffs was for declaration of gift deed null and void qua their rights–Reliefs sought in the suit and counter-claim are totally different and not interdependent–A suit for relief of possession of agricultural land would lie before the Revenue Court in terms of Secs. 88 to 91 to R.T. Act–Held, counter-claim/counter-suit filed by the defendant would not be maintainable before the Civil Court–Trial Court is directed to pass the appropriate order.
