Code of Civil Procedure, 1908–Order 22, Rule 3 & Order 6, Rule 17–Trial Court declined to pass the decree of compromise with the observation that the discription of the property mentioned in the compromise is not matching with the discription mentioned in the suit–Thereafter, the relief clause of the suit was permitted to be amended under the provisions of Order 6, Rule 17 but the Trial Court dismissed the suit on merits–Parties are still in agreement to decree the suit in pursuance of compromise–Impugned judgment set aside and relief is granted in terms of compromise.
