Code of Civil Procedure, 1908–Order 21, Rule 35–Rejection of application–Appreciation of–Earliar, the application under Order 21, Rule 97 had been dismissed and the order was confirmed by first appellate Court –Rights of petitioner in the suit property under the consent decree have been negated and he has lost all locus to further object the execution of the consent decree–Petitioner was required to persuade in second appeal to pass an interim protection order against the dismissal of application under Order 21, Rule 97–Further, all these facts have been suppressed from the Executing Court and in this writ petition–Interference declined.
