Negotiable Instruments Act, 1881–Sec. 138–Plea up to effect that all the five cheques were of different dates and were dishonoured on different dates–Therefore, cause of action arose for each individual cheque was separate and a common trial is not permissible–Cause of action arose on the notice dated 21.08.2021 for non-payment of amount of cheque–Further, it did not prejudice the accused–Rather, it was beneficial for him–It is left open to the trial Court to decide joinder of charges at the appropriate stage–Plea negated.
