Code of Criminal Procedure, 1973–Sec. 319–Prima facie case for exercising the powers–Test which is to be applied–A degree of satisfaction which is more than that if a prima facie case as exercised at the stage of framing of charge but short of satisfaction to an extent that the evidence, if goes unrebutted,
may lead to conviction of proposed accused–In absence of such satisfaction, the Court should refrain from exercising the powers u/s. 319.
