Penal Code, 1860–Secs. 304 Pt. II & 325–Conviction–Proper Section–PW 1 stated that the injury inflicted by the appellant from the back side of gandasi upon the leg of deceased and fracture was caused due to that injury–None of the injury was found inside wound–Prosecution failed to prove that the alleged injury on the head of deceased was caused by the appellant–Held, conviction u/s. 304 Pt. II can not be sustained–However, conviction u/s. 325 maintained.
