Hindu Adoption & Maintenance Act, 1956–Sec. 11(ii)–Juvenile Justice (Case & Protection of Children) Act, 2000–Sec. 41–Provisions of Sec. 41 of Act of 2000 have over-riding effect over the provisions of Sec. 11(ii)–Embargo for adopting a child of same sex envisaged u/s. 11(ii) has been done away under the Act of 2000 for adoption of orphaned, abandoned or surrendered, or child in destitution–Impugned order passed by trial Court for restraining the appellant from adopting the another girl cannot be sustained.
