Code of Criminal Procedure, 1973–Secs. 468 & 469–Insecticides Act, 1968–Secs. 3(k)(i), 17, 18 & 13–Limitation for taking the cognizance–Report of analysis was received on 14.03.2011–Complaint was lodged on 25.03.2014 which is beyond the period of three years–Submission of State that the further report from Central Insecticide Testing Laboratory was received on 09.12.2011, therefore, the complaint is in limitation, cannot be accepted as it is clear from the language of Sec. 469 that the period of limitation shall commence from the date of offence–Complaint is barred by limitation and deserves to be quashed.
