Penal Code, 1860–Secs. 307 & 307/34, 326, 324/34–Conviction–Accused S was serving in police–In the investigation, his name was not included and he was exonerated by the police in the report u/s. 173–Independent witness made the statements against him without any contradiction or infirmity–He was also alleged in the dying declaration–Appellants reached in the forest when the deceased was alone–Appellant S caught hold of him and appellant C inflicted repeated injuries by the gandasi–They left the place of the incident when they felt that the victim has been died–After the incident, victim reached to the house of her brother-in-law and he was provided the medical aid–Appellants were having the illicit relations and the victim objected the same–Held, conviction was justified.
