Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Court Fees & Suit Valuation Act, 1961–Sec. 11–Scope–While considering the application under Order 7, Rule 11, the issue of suit valuation and deficit Court Fees can not be decided because the same is a mixed question of law and facts–Same can be decided only after framing the issues–Further, the issue is essentially between the plaintiff and State and the defendant cannot be termed to be an aggrieved party–Held, the application was rightly dismissed.
