Penal Code, 1860–Secs. 302, 201 & 379–Murder–Conviction–Sustainability–Circumstantial evidence–Information was made by accused after his arrest hence it would not come within the scope of Sec. 27 of Evidence Act–
Hence recovery of stones, wrist watch and silver chain and place of occurrence stated by accused cannot be held having any significance–Evidence of last seen also seems to be an after thought–Police admitted that the photographs
of dead body were taken but they were not brought on record–Body was in decomposed state and it could not be identified–Held, prosecution failed to establish the case beyond doubt and appellant is entitled to be acquitted.
