Rajasthan Panchayati Raj Act, 1994–Sec. 38(4)–Suspension of the petitioner on account of framing of charges in a criminal case–Petitioner filed a revision petition challenging the order of framing the charge which was allowed–Thereafter, the respondents revoked the order of petitioner’s suspension–Complainant filed the revision against the order passed in the revision–This Court quashed the order of Revisional Court and uphold the order of framing the charges–Respondents again placed the petitioner under suspension–However, the petitioner is not facing the trial of offences involving the moral turpitude nor any inquiry u/s. 38(1) is initiated against him–Therefore, the suspension order is liable to be set aside.
