Public Premises (Eviction of Unauthorised Tenants) Act, 1971–Arbitration & Conciliation Act, 1996–Sec. 11–Lease agreement between the parties for a period of three years from 11.09.2012–It was made subject to renewal by mutual consent–Rate of storage was fixed at Rs. 131/- per squire meter per month–Revision of storage charge was communicated and a demand for the enhanced amount was made –Further enhancement in charges–Thereafter, the appellant invoked the provisions of Public Premises Act and the Estate Officer passed the order of eviction–Whether the Public Premises Act, 1971 overrides the Arbitration & Conciliation Act ?–Held, no–Original lease was validly subsisted till 11.09.2015 and the dispute between the parties was related to the period from 12.09.2012 to 11.09.2015–The Public Premises Act neither bars nor overlaps with the scope and ambit of proceedings that were initiated under the Arbitration & Conciliation Act–No error is found in the impugned judgment passed by the High Court.
