Evidence Act, 1872–Sec. 76–Plaintiff produced the copy of the school leaving certificate on record–It was signed by his father–Person who recorded the date of birth in the school record or the person who proved the signatures of his father in the certificate, was not examined–No evidence to show that the entry of the date of birth was made by the official-in-charge which alone would make it admissible as evidence u/s. 35 of the Evidence Act–Held, High Court committed error in interfering with the findings on the basis of the certificate.
