Penal Code, 1860–Secs. 419, 420, 468, 471 & 182–Cognizance for the offence–Set aside by revisional Court–As per prima facie allegations levelled in the complaint, K was having a son with the name of H–Documents collected during the investigation falsify the case of the complainant against the respondent no. 2–Respondent no. 2 produced the death certificate of H which was different than the certificate produced by the complainant–Godnama pertaining to the accused-respondent’s son was prepared in the presence of the then Tehsildar–Trial Court gave the undue weightage to oral evidence and took the cognizance–Revisional Court rightly set aside the order.
