Code of Criminal Procedure, 1973–Sec. 216–Alteration in charge–Determination of question of prejudice–Held, Court must bear in the mind that every accused has a right to a fair trial, where he is aware of what he is being tried and for and where the facts sought to be established against him, are explained to him fairly and clearly and further where he is given a full and fair chance to defend himself against the said charge.
