Criminal Trial–Recovery–Reliability–Witnesses stated that the blood stained clothes were recovered on 4.5.2009–In cross-examination I.O. admitted that the recovery of motor cycle and blood stained clothes was made on 05.05.2009–Seizure memo dated 08.05.2009 is falsified and seizure is liable to be discarded–Further held, accused was arrested in injured condition–Therefore, the prosecution was required to lead evidence regarding his blood group for ensuring the different blood group of the blood stains found on the
recovered clothes.
